Mandatory Compliance Under Ontario Regulation 102/94

Certain establishments, projects, and properties in Ontario are legally required to complete a mandatory annual waste audit under Ontario Regulation 102/94. This audit must be updated yearly, with results carried forward to compare progress and ensure continuous improvement. Failure to comply with O. Reg. 102/94 can result in fines and legal issues.

The following types of properties typically fit the requirements deeming an annual audit necessary:

  • Office Buildings: 107,639 square feet or more (10,000 m²)
  • Retail Shopping Complexes: 107,639 square feet or more (10,000 m²)
  • Restaurants: Annual gross sales of $3 million or more
  • Hotels or Motels: 75 or more units
  • Manufacturing Facilities: Total employees’ hours of 16,000 or more per month
  • Educational Institutions: Annual enrolment of 350 or more students
  • Hospitals: Class A, B, or F public hospitals
  • Construction or Demolition Projects: 21,527 square feet or more (2,000 m²)

Our Professional Auditing Process

Upon completion of a thorough waste audit, you will be provided with two essential documents to guide your waste management strategy. The first is the audit report, which serves as a detailed record of the current waste process, quantifying and classifying the specific waste streams by detailing what’s currently being tossed and what could be recycled. This important report must be retained by both the auditor and the auditee for five years. The second document is the waste reduction plan, a clear and actionable plan designed to help you reduce, reuse, and recycle waste. This WRP provides a practical roadmap for meeting compliance goals and improving your overall environmental impact, as strictly required by O. Reg. 102/94, s. 1.
